Acceptance of Terms
Welcome to My Child's Locket, LLC your online child’s document storage service (hereafter referred to as the "Service"). Your use of the Service is subject to these Terms of Service ("TOS"). My Child’s Locket, LLC reserves the right to update and change the TOS from time to time without prior notice or prior acceptance by you. The TOS will also be applicable to the use of the Service on a trial basis. By using the Service, you signify your irrevocable acceptance of this TOS.
Registration
In order to use the service, you must have a valid My Child’s Locket, LLC user ID and password. To be an Account Holder, you must provide My Child’s Locket, LLC with your name, a valid email address and other information ("Registration Data"). As an Account Holder, you will choose a password during the service's registration process. You are solely responsible for maintaining the confidentiality of the password and account, and are solely responsible for all activities that occur under your password or account. You agree to (a) immediately notify My Child’s Locket, LLC by e-mail at security@mychildslocket.com within 24 hours of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. My Child’s Locket, LLC cannot and will not be liable for any loss or damage arising from your failure to comply with this Section. In consideration of use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
Cancellation
If you decide to cancel the service at anytime, your cancellation will take effect immediately. Before cancellation, you will have the option to purchase a CD with all of your account information, or you can have all your information deleted from My Child’s Locket, LLC. My Child’s Locket, LLC accepts no liability for such deleted information or content once agreed upon by the client.
Renewal
All membership packages will automatically renew upon expiration unless your subscription is cancelled at least 10 days prior to the end of the current subscription package term.
Refund Policy
- Refunds may be granted on a prorated basis for the unused portion of the period purchased, in whole month increments, and not including the current month.
- If you do not wish to continue services with My Child's Locket, LLC, or do not wish to renew your account, it is your responsibility to cancel your account prior to your renewal date to avoid further charges.
Service Availability
My Child’s Locket, LLC, has taken reasonable measures to ensure that the Service is available on a 24/7 basis. However, there will be occasions when the Service will be interrupted for maintenance, upgrades, emergency repairs, or due to the failure of telecommunications links or equipment or other circumstances that are beyond My Child's Locket's control.
Ownership of Website Account and Security
You are solely responsible for maintaining the security of your account, and you are solely responsible for all activities that occur under the account. We have a 10 minute no activity log off policy, this means: if you are not doing anything on the site for 10 minutes, the site will automatically log you off and you will need to log back into the service. You agree to immediately notify My Child’s Locket, LLC by e-mail at security@mychildslocket.com within 24 hours of any unauthorized uses of the account or any other breaches of security. My Child’s Locket, LLC cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You acknowledge and agree that under no circumstances will My Child’s Locket, LLC be liable, including any damages of any kind incurred as a result of such acts or omissions.
Forms Disclaimer
Use of all “Forms” provided by My Child’s Locket, LLC are at your own risk. You are solely responsible for your own actions and decisions when filling out and printing any of the forms on the My Child’s Locket web site.
All “Forms” available for printing through My Child’s Locket web site are general in nature, are not based on the laws of any specific state or other jurisdiction but rather on general parenting principles. These “Forms” are available for use after payment, by printing directly through your web browser software’s print feature.
Photo Disclaimer
My Child’s locket, LLC allows the account holder to upload photos to the website for purposes including the creation of photo albums and photo prints. By using the service to upload any type of photo, you agree that you are solely responsible for your uploaded photos and the consequences of posting them. If you upload any photos in your account than you affirm, represent and warrant to My Child’s Locket, LLC that:
- You own, or have the necessary licenses and rights to, every photo that you have posted on the My Child’s Locket website,
- You have the permission of each and every identifiable individual in each photo you post to post the photo on My Child’s Locket website.
